على المجتمع الدولي الاعتراف بنظام الفصل العنصري الإسرائيلي والتصدي له

سيدتي الرئيسة،

منذ عام 1948، يواجه الفلسطينيون نكبة مستمرة من النزوح والتشريد، كجزء من مساعي إسرائيل لاقتلاع السكان الفلسطينيين الأصليين من منازلهم وأراضيهم وممتلكاتهم. وعلى مدى 72 عامًا، تعمدت إسرائيل تجزئة الشعب الفلسطيني وفصله وعزله استراتيجيًا، وحرمان اللاجئين الفلسطينيين من حقهم في العودة، ومصادرة حقوقهم في الإقامة، وحظر لم شمل أسرهم- وبالتالي فرْض نظام الفصل العنصري على الشعب الفلسطيني، على النحو المشار له في نظام روما الأساسي للمحكمة الجنائية الدولية.

ونتيجة للإفلات المستمر من العقاب، يستمر التضييق على المجتمع المدني بينما تتابع إسرائيل تكميم الأصوات المعارضة لنظام الفصل العنصري بشكل منهجي، من خلال الاعتقال التعسفي الجماعي والتعذيب وسوء المعاملة والعقاب الجماعي واسع النطاق، فضلاً عن الإغلاق غير القانوني لغزة، وحملات التشويه التي تقودها الحكومة الإسرائيلية بحق المدافعين الحقوقيين من أفراد ومنظمات، من خلال خطاب الكراهية العنصرية والتحريض على الكراهية والعنف ضدهم.

في الأسابيع المقبلة، تسعى الحكومة الإسرائيلية لضم أجزاء كبيرة جديدة من الضفة الغربية المحتلة بالمخالفة للقانون. وقد سبق وحذر المقرر الخاص المعني بحقوق الإنسان في فلسطين، من أن خطط إسرائيل "ستبلور نظام فصل عنصري في القرن الحادي والعشرين، وتترك في أعقابها زوال حق الفلسطينيين في تقرير المصير." [1]

لقد أخفقت الدول الأعضاء في الأمم المتحدة في دعم الحقوق غير القابلة للتصرف للشعب الفلسطيني، وعجزت عن وضع حد لإفلات إسرائيل من العقاب. والآن قد حان الوقت للاعتراف بأن إسرائيل أقامت ولا تزال تحافظ على نظام فصل عنصري بحق الفلسطينيين، ينبني على القمع والسيطرة المؤسسية العنصرية، بدءًا من جانبي الخط الأخضر وانتهاءً باللاجئين والمغتربين المحرومين من حقهم في العودة.

وبناء عليه، نحث جميع الدول الأعضاء في الأمم المتحدة على:

1. الاعتراف بالتمييز العنصري الإسرائيلي ضد الشعب الفلسطيني والتصدي له؛
2. المصادقة على الملاحظات الختامية للجنة القضاء على التمييز العنصري للأمم المتحدة لعام 2019، بشأن إسرائيل، والتي اعترفت بسياسات التمييز والفصل العنصريين ضد الفلسطينيين على جانبي الخط الأخضر؛
3. التوصية بإعادة تشكيل لجنة الأمم المتحدة الخاصة لمناهضة الفصل العنصري، ومركز الأمم المتحدة لمناهضة الفصل العنصري، لأجل وضع حد لهذا الظلم.
